Willamette Falls Hospital vs. Clackamas County Assessor

Recent Case:  Willamette Falls Hospital vs. Clackamas County Assessor, Oregon Tax Court, Magistrate Division, TC-MD 090791 B (March 30, 2011). Peter Stoloff represented Willamette Falls Hospital (WFH) in this tax appeal. The court held that the MRI, CT, and other diagnostic imaging equipment operated by WFH in a satellite clinic was exempt from personal property taxation.

Metropolitan Hospitals, Inc. dba Gresham Community Hospital v. SHPDA

Other Reported Cases:  Metropolitan Hospitals, Inc. dba Gresham Community Hospital v. SHPDA, 52 Or App 621, 628 P2d 783 (1981). Peter Stoloff represented Metropolitan Hospitals, Inc. The court held that Gresham Community Hospital was entitled to a contested case hearing regarding its requested certificate of need for a new hospital in Gresham, Oregon. The hospital ultimately obtained a final order approving the 113 bed new hospital.

Metropolitan Hospitals, Inc. dba Meridian Park Hospital v. SHPDA, 51 Or App 365, 625 P2d 1391 (1981). Peter Stoloff represented Metropolitan Hospitals, Inc. The court affirmed without opinion the trial court ruling requiring SHPDA to hold a contested case hearing regarding a certificate of need for Meridian Park Hospital’s 51 bed addition. The hospital ultimately obtained a final order approving the 51 bed addition. See, 52 Or App 621, 625 at fn. 3.
